March 6, 2008 - Revisions to article 6 of the Land Use Regulation; Addition of a new Zoning District;

PUBLIC HEARING
 

Notice is hereby given that the Buena Vista City Council will hold a joint public hearing with the Planning Commission on Thursday, March 6, 2008, at 5:00 PM or shortly thereafter to receive public comment on the following:

                                                               ARTICLE 6

 601.00             CONSERVATION DISTRICT  C-1 

601.03             Conditional Uses.  When, after review of an application and hearing thereon, in accordance with Article 8 Herein, the Buena Vista City Council finds as a fact that the proposed use is compatible with the surroundings use, is consistent with the intent of this Ordinance and of the Comprehensive Plan, is in the public interest, and will comply with all other provisions of law and ordinances of Buena Vista, the following uses may be permitted with appropriate conditions:  (Added by Council 11/13/97) 

601.03-1          Commercial radio, television, and communication towers along with related buildings and equipment provided the requirements of Article 13 are met; 

601.03-2          Single Family Manufactured Homes on Individual Lots (Added by Council 10 June 2004).

NOTE; ELIMINATE MANUFACTURED HOMES FROM THE CONDITIONAL USE PERMIT LIST

 CREATION OF A NEW ZONING DISTRICT:

 

613.00             RECREATIONAL DISTRICT

613.01             Intent of the Recreational District (Rec).  This district covers portions of the City which are occupied by various open uses such as agriculture, National Forests and Parks, state owned forest and park lands and local government owned lands.  This district is established for the specific purpose of providing recreation and open space uses, conservation of water and other natural resources reducing soil erosion, protecting watersheds, and reducing hazards from flood and fire. 

613.02             Permitted Uses.  Within the Recreational District (Rec) the following uses are permitted: 

613.02-1          Wildlife areas or game refuges; 

613.02-2          Flood control and watershed structures; 

613.02-3          Parks, playgrounds and outdoor recreation areas; 

613.02-4          Public utilities; 

613.02-5          Public service or storage buildings; 

613.02-6          Public water and sewage systems.

613.03-1          Commercial radio, television, and communication towers along with related buildings and equipment provided the requirements of Article 13 are met; 

613.03-2          Cabins/Cottages 

613.03-2.1       Cabins/Cottages    For definition purposes for this section: Cabins/Cottages is a building or a group of buildings, whether detached or in connected units, designed primarily for transient travelers catering to the needs of the traveling public by furnishing sleeping accommodations with or without supplying food 

613.03-3          Nursery or tree farms; 

613.03-4          Fish hatcheries; 

613.03-5          Cemeteries: 

613.03-6          Timber production, forests:           

601.04             Accessory Uses.  Where a lot is devoted to a permitted principal use, customary accessory uses and structures are authorized.  The following rules are applicable: 

601.04-1          Existing structures to include towers, power towers, water tanks, telephone poles, commercial buildings and rooftops, may be used to affix commercial radio, television, and communication antennas provided the requirements of Article 13 are met. 

The Recreational District (Rec) will also require a Zoning Map Amendment and this map

amendment is available for review in the Zoning Office located at 2039 Sycamore Avenue

A copy of the application is on file in the City Planner's Office, 2039 Sycamore Avenue, and is available for review from 8:30 AM to 5:00 PM, Monday - Friday.
